Terms of Service

Agreement

TrucksideHQ is a trade name of JB Apparel Brands LLC, a Tennessee limited liability company ("TrucksideHQ", "we", "us"). By using our website or service, you agree to these terms. If you sign up on behalf of a business, you confirm you're authorized to bind that business, and "you" means the business. If a signed order form or written agreement with us conflicts with these terms, the signed agreement wins.

The service

TrucksideHQ provides an AI assistant that answers calls forwarded from your business phone line, collects caller details, books appointments where you allow it, routes urgent calls to the contacts you name, sends call summaries, and sends text messages to callers, such as a missed-call text-back. Some plans include quote follow-up, review requests and campaigns to past customers. The features in your plan are those described on our pricing page or in your order.

Pilot, plans and billing

• Pilot. The 14-day pilot costs $149, paid up front. If you continue to a monthly plan within 14 days after the pilot ends, we credit the $149 against your first month.
• Monthly plans. Plans are billed monthly in advance at the price shown when you sign up. There's no setup fee and no long-term contract.
• Included minutes. Each plan includes a set number of call minutes per month. Unused minutes don't carry over. If you go over, we'll tell you the overage rate and get your agreement before charging it.
• Price changes. We'll give you at least 30 days' notice by email before changing your price.
• Taxes. Prices don't include sales or other taxes, which we'll add where required.
• Late payment. If a payment fails and isn't fixed within 10 days of our notice, we may pause the service until it is.

Cancelling

You can cancel at any time by emailing [email protected]. Cancellation takes effect at the end of the current billing period, and you won't be charged again. We don't refund partial months, except where the law requires it. When the service ends, we'll help you switch your call forwarding back. We may end the service with 30 days' notice, or immediately if you seriously breach these terms.

Your responsibilities

• Give us accurate information about your business, services, pricing rules, hours and emergency procedures, and tell us when it changes.
• Make sure you have the right to forward and use the phone numbers you connect to TrucksideHQ.
• Review your call summaries and booked appointments and follow up with your customers. TrucksideHQ books and passes on information; your business performs the work and remains responsible to your customers.
• Keep any login details we give you secure.

Call recording and texting laws

Calls answered by TrucksideHQ are recorded and transcribed. Some states require every party's consent before a call is recorded. Our standard greeting tells callers they're speaking with an automated assistant and that the call may be recorded. You agree not to remove or change that disclosure without our written agreement.

You're responsible for your business's compliance with laws that apply to your communications with your customers, including the Telephone Consumer Protection Act, state telemarketing and recording laws, and the CAN-SPAM Act. Missed-call text-backs go only to people who just called your business. Marketing campaigns, such as win-back or review messages, must go only to customers who have given the consent the law requires, and we'll honor opt-outs on your behalf.

Not an emergency service

How AI works and its limits

The assistant uses artificial intelligence. It can mishear, misunderstand or make mistakes, and phone networks and third-party systems can fail. We tune the assistant during setup and on an ongoing basis, but we don't promise that every call will be answered, understood or booked correctly. Results such as the figures in our missed-call calculator are estimates, not guarantees of revenue.

Acceptable use

You agree not to use TrucksideHQ to:

• break any law or anyone else's rights;
• send spam, unsolicited marketing or messages without the consent the law requires;
• mislead callers about who they're dealing with, or offer services you're not licensed to provide;
• interfere with, reverse engineer or overload our systems or our providers' systems.

Your data

You own your business information and your customers' information, including call recordings, transcripts and booking details. You give us permission to use it only to provide, support and improve the service for you, as described in our Privacy Policy. We keep it confidential, and we'll give you a copy of your call records on request when your account ends.

Our property

The TrucksideHQ name and logo, our website, scripts, software and documentation belong to JB Apparel Brands LLC. You may use the service while you're a client, but these terms don't transfer any ownership to you. If you send us suggestions, we may use them without obligation to you.

Third-party services

The service relies on phone carriers, text-messaging and voice AI providers, and any scheduling software you ask us to connect. Their own terms apply to your use of them, and we're not responsible for their outages or changes.

Disclaimers

Except as these terms expressly say otherwise, the website and service are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Limits of liability

To the fullest extent the law allows, neither party is liable to the other for lost profits, lost revenue, lost business or any indirect, incidental, special or consequential damages. Our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the event that caused the claim. These limits don't apply to a party's fraud, wilful misconduct or obligations that can't be limited by law.

Indemnity

You agree to defend and indemnify JB Apparel Brands LLC against third-party claims arising from your breach of these terms, your services to your customers, or messages sent at your direction in breach of the law.

Governing law

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Davidson County, Tennessee, and both parties consent to those courts' jurisdiction. Before going to court, each party agrees to try to resolve the dispute in good faith by email for at least 30 days.

Changes to these terms

We may update these terms. We'll post the new version here with a new effective date, and email clients at least 30 days before a significant change takes effect. Continuing to use the service after that means you accept the change.
